Short answer
Three-class system: yes. Class 3: A Class 3 e-bike is pedal-assist only, stops assisting at 28 mph and must have a speedometer. Nobody under 15 may operate one (passengers allowed on a bike built for them), and every Class 3 rider and passenger must wear a bicycle helmet.
| Minimum age | No statewide minimum age for Class 1 or 2 in the e-bike act; under 15 may not operate a Class 3. Separately, under 15 may not operate an e-bike on public roads under the moped-age section (40-6-351 as amended by HB 454). |
|---|---|
| Helmets | Everyone on a Class 3 e-bike must wear an ANSI or Snell bicycle helmet. For other classes, Georgia's general bicycle rule applies: anyone under 16 must wear a bicycle helmet on a bicycle on highways, bike paths, bike lanes and sidewalks (O.C.G.A. 40-6-296(e), as reproduced by the Governor's Office of Highway Safety). |
| Bike paths | Class 1 and 2 may use bicycle and shared-use paths where bicycles are allowed unless a local authority or state agency prohibits it; Class 3 may use a path only if it is within or next to a highway or the managing authority permits it. Natural-surface nonmotorized paths may be regulated separately. |
| Roads | E-bike operators have the rights and duties of bicycle riders; an e-bike is not a motor vehicle and no license or permit is required. |
| Sidewalks | Not addressed in the e-bike act; check local rules. |
Text from HB 454 (2019), which created O.C.G.A. 40-6-300 to 40-6-303 and amended 40-1-1, 40-6-351 and 40-6-352; later amendments were not checked. E-bikes must carry a class, wattage and top-speed label.
