Short answer
Three-class system: yes. Class 3: Class 3 e-bikes (motor assists up to 25 mph, per the statute's definition) are legal only inside New York City. Operators must be 16 or older and anyone operating a Class 3 must wear a helmet.
| Minimum age | You must be at least 16 to operate any e-bike in New York State; local governments may set a higher age. |
|---|---|
| Helmets | A helmet is required for anyone operating a Class 3 e-bike. For other e-bikes, helmets are not always required but recommended; as for any bicycle, riders and passengers under 14 must wear one (VTL 1238(5)). |
| Bike paths | E-bikes cannot be operated on public lands such as parks unless the land is specifically posted as open to them; municipalities can regulate time, place and manner. |
| Roads | E-bikes may use streets and highways with a posted speed limit of 30 mph or less; Class 1 and 2 are legal statewide unless a local law bans them. |
| Sidewalks | E-bikes are not allowed on sidewalks except as authorized by local law or ordinance. |
Class definitions read from the statute (VTL 102-c, nysenate.gov); age, helmet and location rules from the NYS DOT bicycle FAQ. A 2026 bill (S9361) proposes widening helmet rules to all e-bikes; its status was not confirmed.
