Short answer
Three-class system: yes. Class 3: Class 3 is pedal-assist only with motor cutoff at 28 mph (NDCC 39-01-01). A Class 3 must have a functioning speedometer, and anyone under 18 must wear a safety helmet on one (39-10.1-09).
| Minimum age | No statewide minimum age for any class appears in 39-10.1 or 39-01-01. |
|---|---|
| Helmets | Only riders under 18 on a Class 3 e-bike must wear a helmet (NDCC 39-10.1-09). Chapter 39-10.1 and chapter 39-10 contain no other bicycle or e-bike helmet rule. |
| Bike paths | Unless a governmental entity with jurisdiction prohibits it, an e-bike may be operated on any bicycle path or multi-use path. |
| Roads | E-bikes are bicycles under 39-01-01, excluded from motor vehicle, moped and motorcycle definitions. |
| Sidewalks | 39-10.1-09 does not address sidewalks; check local rules. |
Motor must be 750 W or less. Manufacturers must label class, top assisted speed and wattage. Law dates from HB 1148 (2021). Recheck on 2026-10-23: chapters 39-10 and 39-10.1 were searched; the only helmet text is the Class 3 under-18 rule. Resolves the Class 3 age conflict: the statute sets no minimum age.
